Compare US case reading, an England-and-Wales course and compensation analysis, then solve a complete fictional multiple-cause problem.

Study route and exercise: University Reading List editorial project.

Who this book is for

For first-year American law students who want a clear explanation alongside the difficult work of applying tort rules. It is useful for understanding why a person may owe compensation and how an argument changes when facts, defenses or remedies change. Readers studying another legal system should use it comparatively.

Prerequisites

Know the basic shape of a civil lawsuit and learn how to brief a case. Read slowly enough to separate a duty, a breach and a causal claim rather than treating negligence as a single label.

What it covers

The first volume develops foundations, negligence and healthcare liability. The second broadens the discussion to strict and products liability, intentional torts, remedies and other forms of injury. Explanations, cases and separately organized questions make it possible to move between a general rule and the factual problems that reveal its limits.

How to use it

Outline the elements of a claim before reading a case, then mark the evidence relevant to each element. Change one fact and write the strongest argument for each side. When you reach defenses or damages, add them to the same analysis rather than restarting from a memorized summary. Use the author’s volume and chapter headings to keep related rules together.
